Welcome to BlueStead.

By creating an account, accessing, or using BlueStead ("the Service"), you agree to these Terms of Service. If you do not agree to these Terms, do not use the Service.

1. Description of Service

BlueStead is a software platform designed to assist service businesses with operational workflows including customer management, job tracking, scheduling, quotes, estimates, bids, invoicing, communications, AI-assisted drafting and organization, and workflow automation.

BlueStead is provided as a business productivity tool and does not replace professional business judgment.

2. Beta Software Notice

BlueStead is currently provided as beta software. Features may change, malfunction, become unavailable, or produce unexpected results. Users acknowledge that beta software may contain defects, bugs, errors, or incomplete functionality. Users are responsible for reviewing important business actions before relying on them.

3. User Responsibility

You are solely responsible for information entered into the platform, communications sent through the platform, quotes and invoices generated through the platform, scheduling decisions, compliance with applicable laws and regulations, and maintaining backups of critical business information.

BlueStead does not guarantee the accuracy of any generated content.

4. AI-Assisted Features

Certain features may use artificial intelligence to draft messages, generate estimates, summarize communications, interpret user requests, and assist with scheduling and workflow actions.

AI-generated content may be inaccurate, incomplete, or inappropriate. Users are responsible for reviewing and approving content before relying upon or sending it. AI-generated outputs should be treated as recommendations and not as professional legal, accounting, tax, financial, or business advice.

BlueStead does not guarantee the correctness of AI-generated outputs.

5. Communications

Users may send emails, SMS messages, and other communications through BlueStead.

SMS Communications

Users may use BlueStead to send and receive SMS communications with customers.

Message frequency varies depending on customer interactions, appointments, scheduling activity, estimates, invoices, and service communications.

Message and data rates may apply.

Recipients may reply STOP to opt out of SMS communications and HELP for assistance where applicable.

Users remain responsible for obtaining any legally required consent before sending SMS communications.

Users are solely responsible for obtaining required customer consent, compliance with telecommunications laws, anti-spam laws, marketing regulations, and industry-specific requirements.

BlueStead is not responsible for communications sent by users through the platform.

6. Subscription and Billing

Certain features of BlueStead may require a paid subscription. Subscription fees, trial periods, and billing terms will be disclosed at the time of purchase or enrollment. Unless otherwise stated, subscriptions automatically renew until canceled.

Users are responsible for maintaining accurate billing information. Failure to pay applicable fees may result in suspension or termination of access to the Service. Promotional pricing, beta pricing, and founding-member pricing may be offered at BlueStead's discretion and may be subject to eligibility requirements.

7. Availability

BlueStead is provided on an "as available" and "as is" basis. We do not guarantee continuous availability, error-free operation, delivery of messages, delivery of emails, delivery of SMS messages, uninterrupted service, or data retention without interruption.

8. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

BLUESTEAD DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

9. Data and Privacy

Users retain ownership of business data entered into BlueStead. Users grant BlueStead permission to process, store, and transmit data necessary to provide the Service. BlueStead may collect operational and usage information for service improvement, security, support, troubleshooting, analytics, and service maintenance.

While BlueStead takes reasonable measures to protect user data, no system can guarantee absolute security. Users remain responsible for maintaining appropriate backups of important business information.

10. Customer Data Access

BlueStead personnel may access customer account data when reasonably necessary for technical support, troubleshooting, security investigations, compliance obligations, service maintenance, and system administration. Access will be limited to what is reasonably necessary to provide or maintain the Service.

11. Acceptable Use

Users may not use the Service for unlawful purposes, send spam or unsolicited communications, attempt unauthorized access to systems or data, interfere with platform operation, upload malicious software, or reverse engineer or attempt to copy proprietary platform functionality.

BlueStead may suspend or terminate accounts that violate these Terms.

12. Intellectual Property

BlueStead, including its software, workflows, user interface, branding, documentation, and related materials, remains the property of PowerOps Systems. These Terms do not grant ownership of BlueStead intellectual property.

13. Feedback

Users may provide suggestions, ideas, recommendations, comments, or feedback regarding the Service. BlueStead may use such feedback without restriction and without obligation to compensate the user.

14. Limitation of Liability

To the maximum extent permitted by law, BlueStead shall not be liable for lost profits, lost revenue, lost business opportunities, business interruption, loss of customers, data loss, indirect damages, consequential damages, or special damages.

BlueStead's total liability for any claim shall not exceed the amount paid by the user to PowerOps Systems during the twelve (12) months preceding the claim.

15. Indemnification

Users agree to defend, indemnify, and hold harmless PowerOps Systems, its owners, employees, contractors, affiliates, and agents from claims arising from user actions, customer disputes, communications sent through the platform, violations of law, and violations of these Terms.

16. Account Termination

BlueStead may suspend or terminate access at any time for violations of these Terms, abuse of the Service, security concerns, or non-payment. Users may discontinue use of the Service at any time.

17. Changes to Terms

BlueStead may modify these Terms from time to time. When material changes occur, BlueStead may require users to review and re-accept updated versions. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.
